Academic Year 2023/2024
Extreme Speech and Digital Media (7 ECTS)
The course is intended to provide students with an in-depth analysis of a crucial topic in the normative framework of contemporary constitutional democracy, as well as in the public opinion. Students will be encouraged in engaging in critical discussions amongst them, and with the invited speakers (which will be expected to provide a methodologically and substantially diverse approach to the topic).
La libertà di espressione online e i suoi limiti (4 ECTS)
The training activity will be structured in two parts. In a first part, the main substantive (i.e., ethical-political) justifications of freedom of expression, present both in the philosophical debate and in Italian constitutional jurisprudence and that of the ECtHR, will be discussed. In a second part, some borderline cases of freedom of expression will be considered, including by means of case law analysis: that is, cases in which the exercise of freedom of expression is detrimental to the rights of others, or otherwise seems risky from the point of view of the fundamental values of the democratic constitutional state.
